1. Acceptance of Terms

By accessing or using BlueVideo.ai ("Service"), operated by Blue Fermion Labs ("we", "us", "our"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

BlueVideo.ai is a private, family-use AI-powered video generation application that allows you to:

• Generate images from text prompts using AI models
• Convert text to speech using various TTS providers
• Assemble images and audio into videos with effects
• Publish videos to connected platforms (e.g., YouTube)

3. Access and Account Registration

BlueVideo.ai is a private application. Access is restricted to invited family members only. We do not accept public registrations.

• You must be an authorized family member invited by the application owner to use the Service.
• You must sign in with a valid Google account to use the Service.
• You are responsible for maintaining the security of your account and API keys.
• You must not share your API keys or allow unauthorized access to your account.
• You must be at least 13 years old to use the Service.

4. Acceptable Use

You agree NOT to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Create deepfakes or misleading content intended to deceive
• Generate content depicting minors in inappropriate situations
• Infringe on intellectual property rights of others
• Violate any applicable laws or regulations
• Attempt to bypass rate limits or abuse the API
• Reverse engineer or attempt to extract source code from the Service
• Resell or redistribute the Service without authorization

5. Content Ownership

• Your Content: You retain ownership of the text prompts and scripts you provide.
• Generated Content: Videos and images generated by the Service are owned by you, subject to any restrictions from underlying AI model providers.
• AI Model Restrictions: Some AI providers (OpenAI, Stability AI, etc.) have their own terms regarding generated content. You agree to comply with their terms.
• License to Us: You grant us a limited license to process your content solely to provide the Service.

6. AI-Generated Content Disclosure

Content created through BlueVideo.ai is AI-generated. You agree to:

• Disclose that content is AI-generated where required by law or platform policies
• Not misrepresent AI-generated content as human-created
• Comply with platform-specific requirements (e.g., YouTube's synthetic media policies)

7. YouTube Integration

If you connect your YouTube channel:

• You authorize us to upload videos to your channel on your behalf
• You remain responsible for all content published to your channel
• You must comply with YouTube's Terms of Service and Community Guidelines
• You can disconnect your YouTube account at any time

8. API Usage and Rate Limits

• API access is subject to rate limits to ensure fair usage
• Excessive usage may result in temporary or permanent suspension
• We reserve the right to modify rate limits at any time

9. Cost and Usage

BlueVideo.ai is a private family application provided at no charge to authorized family members. The application owner bears all infrastructure and API costs. Usage should be reasonable and respectful of shared resources.

10. Service Availability

• We strive for high availability but do not guarantee uninterrupted service
• We may perform maintenance with or without notice
• We are not liable for any downtime or service interruptions

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $100, WHICHEVER IS GREATER)

12. Indemnification

You agree to indemnify and hold harmless Blue Fermion Labs from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

• You may stop using the Service at any time
• We may suspend or terminate your access for violation of these Terms
• Upon termination, your right to use the Service ceases immediately
• Provisions that should survive termination will remain in effect

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
